BOOKING TERMS & CONDITIONS
By accessing www.wanderlux.co.uk, you agree to the terms and conditions stated below, bound by all applicable laws and regulations, our terms of service and and adhere to hold responsibility for compliance around these applicable local laws accordingly. Failure to comply with these terms and conditions shall prohibit use or access of the website. All materials provided and supplied on the website are directly protected by copyright and trademark law.
CONFIRMATION OF ARRANGEMENTS
All itinerary proposals are presented for client review purposes only – no components are reserved or confirmed until the proposal is formally accepted and a deposit or full payment is received with signed acceptance of the Terms & Conditions by each traveling adult. Upon receipt of the required payment and signed acceptance of the Terms & Conditions, reservations will be made and confirmed for all components. In the event that a service or accommodation is unavailable as proposed, the client or their agent will be contacted to make alternative arrangements.
DEPOSIT AND PAYMENTS
Deposit Payment: A minimum 25% non-refundable deposit is required at the time of booking.
Final Payment: A 75% non-refundable final payment is due up to 90 days prior to tour departure.
CANCELLATION TERMS
After deposit and up to 90 days prior to departure: 25% of Total Tour Cost
90 days or less prior to departure: 100% of Total Tour Cost
PAYMENT METHODS
Depending on the services confirmed through Wanderlux, guests may be required to make an upfront payment. Payment must be made in GBP Pound Sterling either via bank transfer or Stripe. CHANGES BY YOU
A minimum fee of GBP100 may be charged when arrangements are altered at the traveller’s or travel agent’s request after the initial deposit has been received.
WEATHER
Safety is our primary concern. Please note that on some trips, it may be necessary to modify the itinerary due to weather. If so, we will endeavor to add other sights and activities to replace those omitted. If the itinerary is modified to one that is less expensive than the original, the client will be refunded the difference. If the itinerary is modified to one that is more expensive than the original, the client’s advance approval will be obtained and the client may be charged the difference between the original and modified itineraries. If a tour is cancelled and no substitute tour is available, the client will be refunded the full cost of the tour minus any vendor payments. The client is responsible for all additional transportation or lodging costs that are necessitated by weather. In addition, if a client has planned to travel by air to a tour or lodging facility that can also be accessed by ground transportation, there will be no refund if the air transportation is cancelled and the client chooses not to access the tour or lodging facility by ground transportation. There are no refunds if a tour operates but the client decides due to weather or any other reason not to participate. Participation in activities, tours and transportation is not mandatory and purely voluntary. We strongly recommend travel insurance to help protect against unforeseen circumstances.
RESPONSIBILITY AND ACKNOWLEDGEMENT OF RISK
Wanderlux trades under Wanderlux LTD. doing business as Wanderlux, acts only as agent for the various independent suppliers that provide overnight accommodations, transportation, sightseeing, activities, or other services connected with the itinerary. Such services are subject to the terms and conditions of those suppliers as well as those contained herein. By accepting this proposal with my signature below, I hereby release and discharge Wanderlux and its respective owners and employees from and against all liability arising from my participation in any of these services connected with the itineraries arranged by Wanderlux. I agree that Wanderlux has no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by (but not limited to) weather, force majeure, illness, strikes or other labour activities, overbooking or downgrading of services, supplier bankruptcy or insolvency, mechanical failure of transportation or for failure of any transportation to arrive or depart on time, negligence, defect, default of any company or person in performing these services; and in consideration of the benefits I receive from Wanderlux services, I fully release Wanderlux from all such liabilities or claims. Wanderlux and its suppliers are not responsible for cancellations or any expenses due to delays, weather conditions, and mechanical breakdowns or for any other unexpected circumstances as outlined above.
ACTIVITIES
Please note that you may be required to sign a liability waiver before you can participate in certain activities that are included in your package. Copies can be viewed in advance upon request.
ADDITIONAL CHARGES & TRANSFERS BY PRIVATE VEHICLES
Private transfer vehicles are quoted on an estimated period of time. If the actual travel time exceeds the time included in the cost, additional charges will be billed to the client. Any wait time for an airport arrival exceeding half an hour after the scheduled arrival time due to delays for any reason may be at the traveller’s expense and billed accordingly. This also applies for any private tour that exceeds the time included in the proposal and cost including helicopter air time. Other additional charges incurred during your trip will be billed at the end of your travels as authorised by you. These refer to any extra services or incidentals incurred after the start of your trip and may include but are not limited to: an additional transfer or tour, an additional hotel night/room, food & beverages, an additional traveller or any emergency arrangements. All hotel incidentals are to be paid directly by the traveller upon checking out of each property or at the end of the tour.
MEDICAL REQUIREMENTS
Wanderlux expeditions are intended for individuals of a physically fit nature, in good mental and physical health and mobility. Some expeditions are physically challenging. It is a requirement for all participants to declare any medical restrictions, illnesses or dietary concerns prior to payment of deposit and/or balance. In such a case, it may evaluate that some Wanderlux tours may not be suitable for you. Payments received before making Wanderlux aware of any health or physical limitations will not be refunded. We recommend that you do consult your doctor in the case that you are uncertain of your abilities or limitations. The tour leader, photographer or guide has the right to curtail participation from any tour if they feel that you or any of the party are at risk or danger to yourself or the group. Payment of your deposit confirms that no medical conditions are of concern, may that be physical, mental or any other disability there like of.
FORCE MAJEURE
Except where otherwise expressly stated in these booking conditions, we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure.
IDENTIFICATION AND IMMIGRATION
Clients are required to travel with government-issued identification and proof of citizenship for all party members at all times. For itineraries that cross international boundaries, passports are required and proof of required valid documents remains the responsibility of the guest. Parents traveling with children and/or infants are advised to travel with identification and proof of citizenship for each child. If crossing an international border when both parents are not present, the traveling parent may be required to provide a notarised statement from the other parent allowing the child to travel out of the country. Failure to provide such evidence may prevent entry into that country. It is the traveller’s responsibility to ensure visas, where necessary, are obtained. In the occasion where entry is denied by an official, Wanderlux holds no responsibility and no refunds shall be honoured. Past felony convictions may disqualify individuals from entry into foreign countries. Clients are advised that a D.W.I. (Driving While Intoxicated), or D.U.I. (Driving under the Influence) may be considered a felony in other countries. It is the client’s sole responsibility to ensure the immigration eligibility of all traveling party members for any foreign countries included in this itinerary.
ADVANCED PASSENGER INFORMATION (API)
A number of governments are introducing new requirements for air carriers to provide personal information about all travellers on their aircraft to the Authorities before the aircraft leaves the country of origin. The data will be collected either at the airport when you check in or in some circumstances when, or after you make your booking. Accordingly, you are advised to allow extra time to check in for your flight. Where we collect this data, we will treat it in accordance with our privacy policy.
FOREIGN OFFICE ADVICE
We will keep up to date with Foreign Office advice and State Department warnings in regard to the safety of the countries and areas in which you will be travelling, and, where necessary, advise you of any potential risks or changes in that advice. You can then make your decisions regarding travel accordingly. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure. (See clause 7).
SPECIALIST DEPARTURES
If you are booked on named and/or branded specialist led departures, such as Photography led Expeditions, and the advertised specialist cannot lead the trip due to unforeseen circumstances beyond the control of Wanderlux, we reserve the right to provide a replacement leader with similar experience and standing. Normal cancellation policy applies, as stated in the cancellation policy and Wanderlux will not be liable for any extra costs incurred.
THE EQUIPMENT
Your expedition will likely include, lend for the duration of the trip, and need to be returned in its original condition, equipment loaned by Wanderlux, suppliers or partners. This equipment may include camera equipment supplied by Podas, or other digital providers to enhance the photographic expeditions for example. Items and their accessories are billable for should any equipment be lost or damaged by you or any member of the party to the individual held responsible.
OWNERSHIP OF INTELLECTUAL PROPERTY
All intellectual property rights in or arising out of or in connection with your trip shall be owned by us, including but not limited to all photos, images, film and recordings taken of you and your party during your trip (“Images”).
WE DO HOWEVER AGREE:
- not to use any such Images which include any recognisable images of you or any member of your party (“Personal Images”), without your written permission;
- to assign ownership of any Personal Images to the relevant member of your party, upon request,
- to grant you a fully paid-up, worldwide, non-exclusive, royalty-free perpetual and irrevocable licence to use any of the Images for any non-commercial private purpose.
TRAVEL INSURANCE/TRIP CANCELLATION INSURANCE
We require that our clients obtain suitable insurance to protect their vacation investment. A short-term travel insurance policy can cover non-refundable trip costs due to personal or family illness or accident. Wanderlux and Wanderlux LTD holds no liability or responsibility whatsoever in the event of insolvency or bankruptcy by any of the suppliers selected for your trip. We highly recommend that our clients purchase a travel insurance policy that protects their investment from these and other potential losses and/or equipment damages. Wanderlux does not offer trip insurance.
JURISDICTION
Any disputes shall be resolved exclusively in Brighton, United Kingdom.
